We protect ourselves every time we leave on a tour. We have our helmets, gloves and even mirrors. But these things can not protect us from a motorist running a red light or talking on their phones when they should look where they go.
A cyclist will always end up on the losing side of a car versus bicycle accident. Our bikes and bodies have no buffer zones to absorb the physical forces of a collision, so that even a minor impact can have devastating consequences on our bodies and our lives.
Things to know before you go.
After handling many cases of bicycle accidents, I found that there are steps you should take before setting off to ensure you are protected in the event that you really road.
First, every cyclist needs good health insurance coverage - No Exceptions. While the driver that hits you is legally responsible for the cost of your medical care, they do not pay these costs as you need it - only after your case is ready to settle or you get a verdict. Having health insurance means you are able to quickly obtain any medical care you need. Make a copy of your insurance card in your bike bag.
You should also consider a disability insurance policy, especially if you can not afford to go without income for at least six months. Bike accidents often result in serious injury that may keep you from your work for months. This insurance will replace much of the income you May lose as a result of your injuries.
Increase your coverage / uninsured motorist underinsured (UM / UIM) under your insurance policy automobile. Several political Auto extend these benefits to you even when you are hit while riding your bike. This is very important to have as you may likely have to reimburse your health insurance company for money spent on your medical care from the proceeds of your Regulation of the accident to the driver at fault. Large amounts of UM / UIM coverage will ensure that you can always recover for your losses, even if you pay your health carrier. Ask your insurance agent about the availability of such coverage.
What to do after an accident.
Everything you say and do after an accident will affect the final value of your case. In general, you should avoid making statements on what caused the accident except to police or emergency personnel. If the other person has committed a fault for the accident, their insurance company contact you and ask to take your statement. If you do not remember clearly what happened, you should talk to a lawyer before making any statement to the insurance company. Similarly, do not sign anything unless you are positive that you sign.
You should promptly seek medical care and follow the advice of your doctor. Many of us prefer to deal with chiropractors and massage therapists for our wounds, but the insurance company of the other driver may not consider these treatments unless prescribed by a physician real. Also, starting a program of physical therapy sooner rather than later can take months off your recovery time.
To register all your expenses related to the accident. I recommend to my clients save all receipts in an envelope they give to me when they have finished all treatments.
Determine the value of your case.
You have the right to recover for:
1. Damage your bike and other property. In most cases, this element of damages is set relatively early in the case. Sure that the insurance company did fault driver pays the fair market value of your damaged bike. 7. Any out-of-pocket expenses. You are entitled to reimbursement for all of the Out-of-pocket expenses you incur as a result of your accident (prescription drugs, devices medical, etc. ..).
8. The spouse of an injured person is entitled to "loss of consortium damages. This aims to compensate the husband or wife of the victim of the accident at the inability of the injured person to contribute to the household.
Finally, consider hiring a lawyer experienced in this area of law. Studies show that accident victims receive settlements much important when represented by counsel, even after legal fees are paid.
